BUDO MARTIAL ARTS CALGARY

Agreement and Acknowledgement regarding your child

  1. ACKNOWLEDGEMENT AND ASSUMPTION OF RISK OF INJURY TO CHILDREN: I understand there are risks associated with training in the martial arts whether caused  by the children or someone else, in their use of or presence on the Association Center premises. I understand and agree that these risks of injury include, but are not limited to  slips, trips, falls, collisions, thefts, equipment failure, or other such accidents or incidents  that may result in injury, harm, including but not limited to sprains, torn muscles, or  ligaments, broken bones, stroke, heart stress, heart attacks, paralysis, disfigurement,  death, or other forms of pain or suffering. On my own behalf, and on behalf of each of  the minor children above, I fully voluntarily accept and specifically assume these risks of  injury to the children. 

  2. Waiver of Liability and Indemnification Agreement: On my own behalf, and on behalf of each of the minor children above, I agree to release  and discharge from all liability and waive all claims, demands and actions against Budo  Martial Arts Calgary/Eric Fleiger and its directors, officers, employees, agents,  suppliers, and volunteers (collectively, “Budo Martial Arts Calgary/Eric Fleiger”) for any  and all injuries, harms, or damages, sustained by any of the children in connection with  their use or presence on the premises, or their use of facilities, equipment, services,  programs, or activities within or outside its centers, resulting or arising from any and all  negligent, gross negligent or intentional acts or omissions of me, any of the children, other members, guest, visitors, or other persons on the premises. I agree to defend,  indemnify and hold Budo Martial Arts Calgary/Eric Fleiger harmless against any and all  claims brought by anyone against Budo Martial Arts Calgary/Eric Fleiger related to such  injuries, harms or damages. 

TERMS AND CONDITIONS

1. a) Payments are done by a third party by credit card on any day of the month of your  choice. All fees or penalties incurred for late, or NSF payments will be charged on your  next billing attempt. 

 b) There are no makeup classes for missed classes. Membership is month to month.  Auto renewing at the end of initial term.

AUTHORIZATION AGREEMENT

BILLING AND RENEWAL

I (we) understand the administration of the agreement for Budo Martial Arts Calgary is  conducted by Moneris. The services are administrative to the status of membership  and do not exceed to the provision of any benefits of the membership. No changes are  to be made in billing without the express written consent of Budo Martial Arts Calgary.  The member may cancel/resign this agreement after the initial membership term has  been completed as outlined in the membership agreement. Proper cancellation notice  must be given at least 30 days prior the next monthly date. I, the member/payee,  authorize Budo Martial Arts Calgary to process any defaults that may accrue, whether  membership dues to be processed on the next set pre-authorized payment date stated  on my agreement. If unsuccessful after 3 attempts, I acknowledge my agreement  including personal information as well as outstanding fees will be sent to a collections  company chosen by Budo Martial Arts Calgary. I acknowledge that I will not be able to  use the facility until all outstanding fees are paid. I (we) authorize Monaries to debit my  (our) account on behalf of the payee as indicted on the attached credit card  authorization form under the terms and conditions agreed by (me) with the payee until  such time as written notice to the contrary is given. I (we) acknowledge that delivery of  my/our authorization to the payee constitutes delivery by me (us) Monaries at which I  (we) maintain an account and that such merchant is not required to verify that the  payment(s) are drawn in accordance with authorization. The member may revoke this  authorization upon providing at leas t30 days notice to Budo Martial Arts Calgary.  Termination of this authorization does/may not terminate the agreement for goods and  services exchanges. I (we) will notify Monaries in writing of any changes in the account  information or termination of this authorization prior to the next pre-authorized debits.  Items charged under any of the following conditions will be reimbursed subject to a  written notification by me (us) to the branch account within 90 days.

  • (A) I (we) never provided authorization to the payee. 

  • (B) The pre-authorized debit was not drawn in accordance with my (our)  authorization. 

  • (C) My (our) authorization was revoked. 

  • (D) The debit was posted to the wrong account due to invalid/incorrect account  information supplied by Moneris. I (we) warrant that all persons whose  signature(s) are requested to sign on this account have signed this agreement. 


All fees incurred by Budo Martial Arts Calgary for disputed charges is the responsibility  of the member. 

ADDITIONAL TERMS AND CONDITIONS

The following as set forth are part of the membership agreement and members are obligated to observe and comply with the same.

  • All members must follow all terms and conditions of the facility of Tuxedo Park Community Association

  • Budo Martial Arts Calgary may use images and videos of its members and staff on its website and or various platforms.

CLUB USAGE

Failure of member to use Budo Martial Arts Calgary does not relieve the member/buyer obligation to make monthly payments as outlined in the membership agreement.

LOST OR STOLEN ITEMS

Budo Martial Arts Calgary is not responsible for the loss or theft or damage to personal property.

MEMBERSHIP NOT REFUNDABLE

The member/buyer acknowledges and agrees that Budo Martial Arts Calgary has earned the membership fee and monthly dues payments, and that notwithstanding any voluntary withdrawal or proper cancellation, suspension of membership or failure of the member to take advantage of the privileges of membership for any reason whatsoever, the member shall not be at any time entitled to a refund of all or any part of monies paid and shall remain liable for any part thereof not yet paid at any time.

ALTERATION OF MONTHLY DUES AMOUNTS

Not withstanding the reference to any set monthly dues herein, Budo Martial Arts Calgary may, not more than once in each calendar year of membership, increase the amount of dues payable by any amount not in excess of 15% of the rate previously applicable and the member agrees to pay such increases. If in any given year or years Budo Martial Arts Calgary does not institute such increase, the right to do so in a later year shall remain.

CANCELLATION/RESIGNATION BY MEMBER

This membership agreement may be cancelled/resigned by giving:

30 day written notice For all martial arts membership prior to the renewal date or the next monthly dues payment date any month thereafter. Member is responsible for all payments during the 30 day notice request or the request to cancel will be denied. In the event the member wishes to cancel/resign his/her membership he or she may do so by one of the following:

  • Letter to Budo Martial Arts Calgary clearly outlining your intent to cancel/resign. Request cannot be submitted within the first 10 days of signing up and at its sole discretion, and without or any further notice to the member, Budo Martial Arts Calgary may terminate this agreement and cancel the membership where: • a) the member is guilty of conduct unbecoming a member or in any other respect is in default of any term of any term of or otherwise has breached this agreement, and has not cured such default or breach within 15 days after the member’s receipt of written notice thereof from Budo Martial Arts Calgary: or

  • The member is again guilty of conduct unbecoming a member or commits a further default or breach, and such default or breach or conduct is similar to that of which written notice previously has been given; or

  • The member defaults in any payment due pursuant to this agreement and such default continues for a period of 15 days after written notice of the defaults and demand for a payment: or

  • The member commits a second or other further default in payment. Termination of this agreement pursuant to this clause not in any way limit or restrict the right of Budo Martial Arts Calgary to charge any fees accrued prior to termination including any penalties or compensation for loss or damage or otherwise enforce rights under the agreement.

  • Cancellation/resignation request received later than 30 days prior to the next monthly dues payment date will take effect the next calendar month.

  • Memberships can’t be canceled over the phone or by email without prior written permission.

RULES AND REGULATION

Budo Martial Arts Calgary reserves the right to maintain rules and regulations governing memberships, including but not limited to a code of Conduct, a breach of which shall constitute conduct unbecoming a Budo Martial Arts Calgary member. All results, regulations and privileges of membership, including but not restricted to membership dues, facilities, services and hours of operation are subject to change at any time without notice in the sole absolute discretion of Budo Martial Arts Calgary. Any such changes do not in any way affect the provisions of the membership agreement or release the member from any obligation hereunder. (Subject to reasonable changes without advance notice). In consideration of Budo Martial Arts Calgary providing the member with access to the facilities.

  • Releases and forever discharges Budo Martial Arts Calgary it’s partners, principals and employees from all claims from the member, or his/her executors, administrators, heirs, successors or assigns may have for any injury, including injury resulting in death, or damage howsoever caused (including negligence), and

  • Indemnifies Budo Martial Arts Calgary it’s partners, principals and employees from any liability, losses, damages or expenses arising from injury to persona or damages to property, and

  • Agrees to be responsible for any and all damages (caused by the member his/her guest(s) of the premises)


The undersigned buyer’s (herein referred to as Member) signature hereby acknowledges this membership is purchased in accordance with the terms and conditions contained herein all pages of the membership agreement) and has not relied on any statements written or oral other than contained herein. I have read and understood all Rollover and cancellation Policies.


There will be no refunds for the month paid.

  1. (a) A notice of 30 days must be given to cancel membership or put membership on hold. (b) Memberships can be placed once a year on hold must give 30 days notice before next billing date. (c) Holds on memberships no longer then 3 months or grace period given with a minimum of 1 billing cycle in which member will be charged again. (d) If membership fees are late, children will be allowed one grace period class after which your child will be asked to sit out until payment is made.

  2. For Every New Member you refer and register you will receive one month free.

  3. Children will be required to wear uniform at a cost of $60.00.

  4. When your child is ready to test for their next belt level a fee of $50 must be paid prior to testing.

RULES AND ETIQUETTE

  • No shoes allowed in the dojo at anytime

  • Proper training attire (GI) must be worn

  • No Gum or Food allowed in the dojo

  • Water bottles are allowed

  • No spectators (including parents) are permitted in the dojo

    during class

  • No watches, or jewelry should be worn

  • Please ensure fingernails and toenails are trimmed for safety

  • Students should always be quiet and respectful in the facility, no

    fooling around

  • Students are to bow when entering and exiting the dojo

  • Students are to bow to one another when working with a partner

  • Students should always treat each other with respect and the

    instructor with respect

  • Martial Arts training should be done in the dojo or under parent

    supervision only

  • Martial Arts training is to be used only for self defense

  • Students will always represent the Silverback troop with

    integrity, honesty, and respect inside and outside of the dojo
